Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you and [OPERATOR NAME] (“Pop Off,” “we,” “us” or “our”) governing your access to and use of the Pop Off website and application (the “Service”). By creating a profile, playing as a guest, or otherwise using the Service, you agree to be bound by these Terms and acknowledge our Privacy Policy, which describes how we handle personal information. If you do not agree to these Terms, you may not use the Service. If you are under 18, you should review these Terms with a parent or legal guardian.

1Eligibility

You must be at least 13 years of age to create a profile. You agree to provide your true year of birth when asked, and to maintain no more than one profile. If we learn that a profile belongs to a person under 13, we will delete it.

2Your profile

  • You are responsible for keeping your password confidential and for all activity that occurs under your profile. You agree to notify us promptly at [CONTACT EMAIL] if you believe your profile has been used without your permission.
  • Because we do not collect an email address, we are unable to send password reset messages. If you forget your password, you may contact us at [CONTACT EMAIL], and we will make reasonable efforts to verify that the profile belongs to you before restoring access. We may decline to restore access where we cannot verify ownership.
  • Usernames and crew names may not be crude, hateful, harassing or insulting; may not consist of a real person's full name; and may not suggest an affiliation with Pop Off or its staff. We may change or remove any name that does not comply with this section, in our sole discretion.

3Acceptable use

You agree that you will not, and will not attempt to:

  • use bots, scripts or other automated means to play, submit answers, or create profiles;
  • consult outside sources for answers during a ranked match, or disclose questions to others for the purpose of helping them cheat;
  • deliberately lose matches, or coordinate with other users, in order to manipulate ratings, rankings or league placements;
  • harass, bully, threaten or otherwise harm other users;
  • interfere with, disrupt or overload the Service, circumvent any rate limit or other technical restriction, or access the Service by means other than its interface;
  • copy, scrape or extract questions or other content from the Service in bulk; or
  • submit question reports that you know to be false, or that are intended to harass or to disrupt the Service.

If we determine that you have violated this section, we may, without prior notice, reset your ratings, remove results, or suspend or terminate your profile.

4Educational content and score estimates

The questions in the Service are original practice material written in the style of the SAT, and some are written or reviewed with the assistance of artificial intelligence. They are not official SAT questions, and the Service is not a test preparation course. Ratings and ranks are measures internal to the Service. Any SAT score estimate displayed in the Service is an approximation derived from those ratings; it is not based on official score data and is not a prediction or guarantee of any score you will achieve. Coaching notes generated by artificial intelligence may contain errors and should be treated as guidance only.

5Tutor links

The Service allows you to create a link to a read-only page summarizing your progress, as described in our Privacy Policy. You are responsible for deciding with whom to share that link. Anyone who has the link can view the page without signing in, and we are not responsible for any further disclosure by a person with whom you share it. You may disable the link at any time, after which it will no longer work.

6Trademarks

SAT® is a trademark registered by the College Board, which is not affiliated with, and does not endorse, Pop Off.

7Intellectual property and license

The Service, including its questions, explanations, characters, artwork, software and other content, is owned by us or our licensors and is protected by applicable intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable license to use the Service for your own non-commercial practice. No other rights are granted to you.

You retain any rights you hold in the usernames and crew names you create, and you grant us a worldwide, royalty-free license to display them within the Service. If you submit a question report or other feedback, you grant us a perpetual, royalty-free license to use it to maintain and improve the Service, without obligation to you.

8Changes to the Service

The Service is currently provided free of charge. We may add, modify or remove features, reset seasons, leagues or ratings, or suspend or discontinue the Service, in whole or in part, at any time. If we decide to discontinue the Service, we will make reasonable efforts to notify you in advance.

9Termination

You may stop using the Service at any time and may request deletion of your profile by contacting us at [CONTACT EMAIL]. We may suspend or terminate your access to the Service if you breach these Terms. Sections 4, 7, 10, 11 and 12 survive any termination of these Terms.

10Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ITS CONTENT WILL BE ACCURATE OR COMPLETE, OR THAT YOUR USE OF IT WILL IMPROVE YOUR SAT SCORE.

11Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, AND OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED [$50]. Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the limitations above may not apply to you.

12Governing law

These Terms are governed by the laws of the State of [STATE], United States of America, without regard to its conflict of laws principles.

13Changes to these Terms

If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later.
